Product Warranty
Western DataCom
Co., inc. (hereinafter referred to as "Western") warrants to
the purchaser, for a period of twelve (12) months from the date of shipment,
that the products of Western being sold to the purchaser will perform
in accordance with Western's published specifications. The obligation
of Western is limited, however, to the replacement or repair of defective
parts, at its option, upon the return of the product prepaid to Western.
Because products
furnished hereunder are used or combined by purchaser with other equipment
or components not furnished by Western, purchaser agrees to indemnify
Western for all claims resulting from the user of incorporation of said
products in the purchaser's equipment. End-user shall be solely responsible
for determining suitability for use of products of Western, who shall
not, in any event, have any liability with respect thereto.
Western shall
not be responsible for circumstances beyond its control and this Warranty
shall not apply to products which, in the sole judgment of Western, have
been subject to contamination, tampering, negligent handling, misapplication,
operation beyond published specifications, or other misuse. Changes to
the product or attempted repair of the product void this Warranty.
IT IS
EXPRESSLY AGREED THAT THIS WARRANTY IS IN LIEU OF ANY AND ALL OTHER WARRANTIES
AND LIABILITIES, EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY
WARRANTY OF MERCHANTABILITY, FITNESS FOR ANY PURPOSE, INFRINGEMENT, AND
ANY LIABILITY FOR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF THE
PRODUCTS SOLD HEREUNDER. THE FOREGOING STATES WESTERN'S ENTIRE AND EXCLUSIVE
LIABILITY; IN NO EVENT SHALL WESTERN BE LIABLE FOR ANY LOSS OF ANTICIPATED
PROFITS, CONSEQUENTIAL DAMAGES, OR LOSS OF USE OF ANY EQUIPMENT, INSTALLATION
OR SYSTEMS.

Support department. No product returns will be accepted without prior
approval from Western DataCom.
